In these terms, “we”, “us” and “Purnext” mean Merci Ltd, and “you” means the person or business placing the order.
Using this website
You may use this site to browse our range, request quotes and place orders. Please do not attempt to disrupt the site, extract data from it by automated means, or use it for anything unlawful. We may change or withdraw parts of the site at any time, and we do not promise it will always be available without interruption.
Products and descriptions
We describe our products as accurately as we can. Photographs and illustrations are indicative — packaging, colour and minor specification details can change between production runs. Where a precise specification matters to you, ask us to confirm it in writing before you order. Machine specifications given by manufacturers are subject to change.
Prices
Prices shown on the New Zealand site are in New Zealand dollars and exclude GST. Prices shown to visitors in Germany are in euros and exclude VAT. Prices exclude delivery unless we say otherwise; delivery is quoted separately, and freight on machines is quoted per order.
We may change prices at any time, but a change will not affect an order we have already accepted. Where a quote has been issued, it is valid for the period stated on the quote. If a price is listed in obvious error, we may cancel the order and refund you in full rather than supply at that price.
Orders
An order placed through the website or accepted against a quote is an offer to buy. A contract is formed when we confirm the order or dispatch the goods, whichever happens first. We may decline an order — for example where stock is unavailable, where delivery is outside the area we serve, or where we cannot verify the order details.
Payment
Payment is due as stated on the order confirmation or invoice. Where card payment is offered online, it is processed by a third-party payment provider; we do not receive or store your full card details.
Goods remain our property until they have been paid for in full. Risk in the goods passes to you on delivery.
Delivery
We deliver to addresses in the areas shown at checkout. Delivery times are estimates, not guarantees, and depend on the carrier. Larger equipment is sent by freight and may require someone on site to receive and unload it.
Please check your delivery when it arrives. If anything is missing, damaged or not what you ordered, tell us within 3 working days so we can put it right.
Returns and refunds
Returns, refunds and who pays return freight are set out in full on our Returns & Refunds page, which forms part of these terms. In short: tell us within 3 working days, do not send anything back before contacting us, and where the return is due to a fault or a problem with our product, Merci Ltd covers the cost of return shipping.
Warranty and after-sales service
All Purnext machines carry a 12-month warranty from the date of delivery, covering mechanical faults, technical issues and product defects. Where a fault can be resolved with a replacement part or an adjustment, we will usually do that rather than replace the machine, and we will tell you which applies — and whether it is covered — before any work is carried out.
The warranty does not cover normal wear, consumable parts, damage from misuse, accident or neglect, use outside the manufacturer’s instructions, or repairs and modifications carried out by someone else. Support, servicing and spare parts are described on our After-Sales Service page.
Your rights as a consumer
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.
Where goods are supplied to a business for business purposes and both parties are in trade, the parties agree that the Consumer Guarantees Act does not apply, and that it is fair and reasonable to be bound by this agreement.
If you are a consumer in the European Union, you keep the rights given to you by the mandatory consumer law of the country you live in, including any statutory right of withdrawal, and nothing here takes those away.
Our liability
Subject to the paragraph above, and to the extent the law allows, our total liability in connection with an order is limited to the amount you paid for the goods concerned, and we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data.
We are not responsible for delays or failures caused by events outside our reasonable control, such as supply shortages, carrier disruption or natural events.
Intellectual property
The Purnext name and logo, the site’s text, images and layout belong to us or to our suppliers. You may not copy or reuse them commercially without our written permission.

Changes to these terms
We may update these terms. The version published on this page when you place your order is the version that applies to that order.
Governing law
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory laws of your country of residence.
